We have a strict anti-spam policy. We will investigate any accusations
of spam relating to us or our affiliate program and cancel affiliates
who we feel are guilty of this practice. No outstanding balances will
be paid and we will contact your ISP personally.
While we attempt to track all orders that are placed, with telephone
orders and wire transfers it is sometimes impossible to determine the
affiliate involved. These orders comprise appproximately 15% of all
orders. While we will make our best effort to compensate you for these
orders, we can not guarantee exact tracking.
Affiliate credits are issued on licensed software and hosting fees only. See below for information on how hosting commissions are calculated.
Commisions for hosting apply only to the initial contract period.
If the contract is monthly, your commission will be equal to 10% (or
5% for sub-affiliates) of the monthly fee multiplied by two. For six
month contracts, the commisson will be 10% (or 5% for sub-affiliates)
of the monthly fee payable monthly for six months. You must remain an
affiliate for that time. Please note that affiliate rebates cannot be applied to your own hosting fees.
Affiliates must have at least one active link using their Affliate
URL on their website in order to qualify for commissions.
Affiliates who do not generate any sales for six consecutive months
will be deemed inactive and be removed.
BuildACommunity.com or Ecreations Software logos and trademarks may
not be used in any way that may be construed as disparaging or promoting
products other than those sold by Ecreations Software.
We reserve the right to refuse payment for sales generated as the
result of misleading or dishonest advertising on your part.
In order to qualify for commissions on sub-affiliate sales in any
given month, an affiliate must personally have at least one active link
that has generated at least one click-through.
Customers who purchase products and services through the Affiliate
Program will be deemed to be customers of BuildACommunity.com. Accordingly,
all BuildACommunity.com rules, policies, and operating procedures concerning
customer orders and service will apply to those customers. We may change
our policies and operating procedures at any time. Prices and availability
of our products and services may vary from time to time. BuildACommunity.com
policies will always determine the price paid by the customer.
BuildACommunity.com will be solely responsible for processing every
order placed by a customer on the Affiliate Site. BuildACommunity.com
reserves the right to reject any order that does not comply with our
rules, operating procedures and policies.
BuildACommunity.com will send a check for the applicable commissions
within approximately 30 days after the end of each calendar month. If
any order that generated a referral fee is returned by the customer,
or if there are any returned checks or charge backs, the amount will
be deducted from the next monthly payment. If there is no subsequent
payment, the Affiliate will be invoiced.
BuildACommunity.com reserves the right not to accept any site into
the Affiliate Program based on site content. Sites that Do Not Qualify
for the BuildACommunity.com Affiliate Program include sites which:
- promote violence
- promote discrimination based on race, sex, religion, nationality,
disability, sexual orientation, or age
- promote illegal activities
- violate intellectual property rights
You and we are independent contractors, and nothing in this Agreement
will create any partnership, joint venture, agency, franchise, sales
representative, or employment relationship between the parties. You
will have no authority to make or accept any offers or representations
on our behalf. You will not make any statement, whether on your site
or otherwise, that reasonably would contradict this statement.
We will not be liable for indirect, special, or consequential damages
(or any loss of revenue, profits, or data) arising in connection with
this Agreement or the Program, even if we have been advised of the possibility
of such damages. Further, our aggregate liability arising with respect
to this Agreement and the Program will not exceed the total commissions
paid or payable to you under to this Agreement.
